Job Duties: Attorney will represent Veterans at Court of Appeals for Veterans Claims (CAVC), and the United States Court of Appeals for the Federal Circuit.

Minimum Requirements:

· Must have license to practice law (any state bar admission is sufficient)

· Must have 3+ years of VA disability law experience

· Must be accredited by the Department of Veterans Affairs (VA)

· Must be admitted to practice before the CAVC

· Must be admitted or seek and obtain admission to practice before the United States Court of Appeals for Federal Circuit.

Geographic Requirements: In-office or remote work position

Job Posting: VA Disability Appellate Attorney (CAVC Focus)

Position Summary

We are seeking an experienced and detail-oriented Appellate Attorney to join our Veterans Disability Practice Group. This role focuses primarily on representing veterans before the United States Court of Appeals for Veterans Claims (CAVC), identifying legal error in Board of Veterans’ Appeals (BVA) decisions, drafting persuasive federal briefs, negotiating Joint Motions for Remand (JMR), and securing Equal Access to Justice Act (EAJA) attorney fees.

Key Responsibilities

• Appellate Record Review: Conduct in-depth analysis of Board of Veterans’ Appeals (BVA) decisions and the complete Record Before the Agency (RBA) to identify clear and unmistakable error (CUE), procedural defects, and misapplications of Title 38 law (38 U.S.C. and 38 C.F.R.).

• Brief Writing & Advocacy: Draft high-quality principal briefs, reply briefs, and motions for single-judge or panel review before the CAVC.

• Settlement & Negotiation: Participate in Rule 33 Staff Conferences and negotiate Joint Motions for Remand (JMR) with the VA Office of General Counsel (OGC).

• EAJA Fee Petitions: Prepare and file petitions for attorney fees and expenses under the Equal Access to Justice Act (28 U.S.C. § 2412).

• Case Management & Client Relations: Manage strict federal court filing deadlines, maintain communication with veteran clients throughout the federal appeal process, and explain complex legal concepts clearly.

• Agency Remand Handling: Advise on implementation of CAVC remands as they return to the BVA or VA Regional Offices (VARO).

Qualifications & Requirements

Mandatory Requirements:

• Education: Juris Doctor (J.D.) from an ABA-accredited law school.

• Bar Admission: Active, good-standing license to practice law in at least one U.S. state or territory.

• CAVC Bar Admission: Admitted to practice before the United States Court of Appeals for Veterans Claims (or eligible for immediate admission).

• VA Accreditation: Active accreditation as an attorney with the Department of Veterans Affairs (VA).

• Experience:

• • Minimum 2–5 years of legal experience, with a heavy emphasis on VA disability compensation law.

• • Demonstrated experience handling CAVC appeals (e.g., drafting principal briefs, negotiating JMRs, handling Rule 33 conferences).

• Technical Skills: Proficiency with electronic court filing systems (CM/ECF and ACMS) and legal research tools (Westlaw, LexisNexis, Case411/Veterans Law research tools).

Preferred Qualifications:

• Prior experience as a CAVC judicial law clerk, BVA Veterans Law Judge staff attorney, or VA OGC attorney

• Experience with Federal Circuit appeals under 38 U.S.C. § 7292.

• Strong foundation in administrative law principles (Chevron/Auer deference issues, arbitrary and capricious standards, duty to assist/notify).
